[1] The Applicant is entitled to cross-examine Moira Lucy Escott on her affidavit sworn on April 3, 1998. If that is what the Applicant wishes to do, the Applicant can do so at the Applicant's expense.
[2] I have read the reason given by Lucy Escott as to why she does not wish to be cross-examined by means of a telephone conference call.
[3] I am satisfied that what she states is most reasonable.
[4] If the Applicant wishes to cross-examine Lucy Escott on her April 3, 1998 affidavit, arrangements, at the applicant's expense, should be made to hold the examination in Toronto.
