ASSESSMENT OF COSTS - REASONS

FRANÇOIS MARTIN, ASSESSMENT OFFICER

[1]        On January 8, 2001, the Court allowed the plaintiff's motion for judgment by default with costs. At the request of the plaintiff, the assessment proceeded without a personal appearance by the parties. It should be noted that the defendant made no submission in opposition to the plaintiff's bill of costs.

[2]        The fees requested by the plaintiff under Tariff B, Column III, are as follows: item 1 (7 units), item 4 (4 units) and item 26 (6 units).

[3]        Counsel's fees requested are granted, except as regards the claim made under item 26 of the Tariff. As the bill of costs was quite straightforward and not opposed, 2 units will be awarded for that item.

[4]        In view of the foregoing, we award the plaintiff the sum of $1,430, namely 13 units x $110/unit.

[5]        Disbursements in the amount of $202.05 are awarded as such.

[6]        The plaintiff's costs are assessed and allowed in the amount of $1,632.05. A certificate is issued for that amount.
