REASONS FOR ORDER

NOËL, J.:

     This is an application for judicial review of a decision of the Refugee Division's decision, dated May 7, 1996, declaring that the Applicant's claim to refugee status had been abandoned, pursuant to section 69.9(6) of the Immigration Act.

     At the hearing, Counsel for the Applicant withdrew two of the three arguments which had been raised in support of the application. He limited his argument to the suggestion that the Board did not have before it evidence from which it could reasonably conclude that the Applicant had abandoned his claim. After having reviewed the record, I have come to the opposite conclusion. Indeed, the behaviour of the Applicant makes it plain and obvious that the claim which he has filed was not serious. The Board had ample evidence from which it could conclude that the claim had been abandoned.

     The application is dismissed.
