     ORDER AND REASONS FOR ORDER

     UPON motion by the Plaintiff, and upon considering the material filed, and the submissions of counsel;

     Notwithstanding Mr. Erdle"s forceful arguments in opposition to the motion, I am of the view that the motion ought to be allowed. The Showmax defendants do not oppose the motion and Mr. Erdle"s arguments go to the merits of the matter, and consequently, should and will be raised, I am sure, in the Statement of Defence.

THIS COURT ORDERS that:

1.      The following defendants are added:

(a)      Showmax Montréal, Inc.;

(b)      The Montréal Forum Entertainment Center Company, a partnership comprising Canderel Properties Limited, Simon Property Group, DLJ Real Estate Capital Partners and Madison Marquette;

(c)      The Forum Entertainment Center Company;

(d)      The Forum Entertainment Center G.P., a partnership comprising SDG Montréal Forum Company, Canderel Properties Limited and Société RECP de Montréal; and

(e)      SHOWMAX.

2.      The Statement of Claim is amended to the form attached as Schedule A to the motion.

3.      Costs in the cause with respect to the defendants, other than the Showmax defendants, against whom there shall be no costs.
