     REFEREE'S REPORT

M. LAMY

An order was rendered by Mr. Richard Morneau, Prothonotary, on August 20, 1996, granting judgment to the Plaintiffs against the Defendant Prosperity Container Line S.A. and referring pursuant to Rule 500 of the Federal Court Rules the issue of damages.

On April 29, 1997, Mrs. Teresa A. Cianciaruso filed the affidavit of Mr. Jacques Meunier establishing that Plaintiffs' shipment of men's shirts arrived at Montreal on November 13, 1994, in a damaged condition. As it appears from the survey report and the supporting documentation filed as Exhibit "B" to Mr. Meunier's affidavit, Plaintiffs have suffered losses in the amount of $3,100. It is therefore recommended that they be awarded said amount.

MONTREAL, QUEBEC, THIS 30th DAY OF APRIL 1997.
