     TAXATION OF COSTS -- REASONS

MICHELLE LAMY, TAXING OFFICER

[1]      Pursuant to a motion by the plaintiff for judgment by default, the Court on June 27, 2000 ordered the defendant to pay the sum of $18,512.21 with interest and costs of the action since the date of service. On July 19, 2000 the plaintiff filed its bill of costs and asked that it be taxed without a personal appearance by the parties.

[2]      On July 24, 2000 we sent Antares Marine Inc. a copy of the bill by registered mail and asked it to submit its comments in writing by August 7, 2000. As there have been no submissions, we are prepared to tax the plaintiff's costs.

[3]      Consequently, fees in the amount of $1,100 are awarded for the following items in Tariff B: item 1 (5 units), item 4 (3 units), item 25 (1 unit) and item 26 (2 units). Under item 26 we reduced the number of units requested to 2 as the proceeding was not opposed. The disbursements in the amount of $86.39 for filing and serving the action are allowed as such.

[4]      The costs of the instant case are taxed in the amount of $1,186.39 and a certificate is issued for that amount.
