[1]          This action was dismissed with costs on September 2, 1997. Mr. Louis Sébastien, the solicitor for the defendant, filed his bill of costs on July 24, 2000 with the request it be assessed without the personal appearance of parties. The plaintiff was given until August 31, 2000 to file written representations and the defendant until September 8, 2000; to date no response has been filed.     

[2]      The bill of costs contains four (4) items of assessable services; these are all toward the lower end of the scale in column III. I will therefore allow 5 units for item 2, 5 units for item 5, 1 unit for item 25 and 4 units for item 26 as requested by counsel.

[3]      The two (2) items of disbursement are for expenses incurred to effect service of Court documents upon the plaintiff and each disbursement is supported by evidence. These will be allowed in the amount of 51,59$.

[4]      The costs of the defendant are assessed and allowed in the amounts of 1 500,00$ for fees, 51,59$ for disbursements and 105, 00$ for the G.S.T. A Certificate of Assessment will issue in the amount of 1 656,59$.
