ASSESSMENT OF COSTS " REASONS

MICHELLE LAMY, ASSESSMENT OFFICER

[1]      On October 27, 1999, Ms. Marie-Andrée Legault, the defendant"s counsel, filed her bill of costs pursuant to the judgment rendered in this matter last July 8 and asked that the assessment proceed without the personal appearance of the parties. On October 29, we wrote to counsel for the plaintiff asking it to submit its comments in opposition to the said bill by November 15. It should be noted that as of this day no representation has been received in the Registry of this Court.

[2]      In view of the foregoing, the defendant"s fees are allowed as such with the exception of item 26. I allow 2 units for the assessment of costs since this proceeding was not contested. The defendant"s fees are therefore $2,400.00. As to the disbursements in the amount of $585.21, they are likewise allowed.

[3]      The defendant"s fees resulting from this matter are fixed at $2,985.21. A certificate shall issue in that amount.
