Docket: T-1093-97

BETWEEN:

     THE MINISTER OF CITIZENSHIP

     AND IMMIGRATION,

     Plaintiff,

     - and -

     EDUARDS PODINS

     Defendant.

     REASONS FOR ORDER

McKEOWN J.

[1]      The Applicant has since August 26, 1998, served the Respondent with 6 feet of documents. Some of these documents were already in the possession of the Respondent, but there were at least 1,000 new documents. The Applicant stated there were only 18 new documents upon which she relied. However, as the Respondent correctly submitted,

all of the documents must be read by counsel since some might assist the Respondent.

[2]      In my view, the Respondent cannot be expected to review this number of documents and be prepared to start September 15, 1998. I do not condone the Applicant"s presentation of these documents at the last minute. I accordingly granted an adjournment until September 21, 1998. The adjournment would have been longer, but for the fact that the Applicant"s expert witness is a professor from Australia who has arranged his schedule to be present the week of September 21. The date for the remainder of the case will be set the week of September 21, taking into account Respondent"s counsel"s problems that may arise from the new documents. I cannot overemphasize the inconvenience and interference with the court schedule as a result of the late production of documents by counsel for the Applicant.
