[1] This is the assessment of costs for the judgment delivered on July 29, 2005, ordering the striking out of the City of Montréal’s statement of claim. At the request of the defendant, the assessment was based on the written submissions of the parties.
[2] Having reviewed the submissions, we award fees in the amount of $1,518.33 ($1,320.00 plus GST/QST) for items 5 (7 units) and 26 (4 units) under Tariff B. In light of the defendant’s submissions, we maintain the number of units requested under item 5 because of the volume of work required to prepare the motion to strike out the action, including the reply documents. At the plaintiff’s suggestion, we allow 4 units for the assessment of costs, since this is a relatively simple proceeding.
[3] However, all expenses incurred in the case are allowed in the amount of $366.76, being proven by affidavit and uncontested.
[4] In conclusion, the costs of the defendant are assessed and allowed in the amount of $1,885.09. A certificate is issued for this amount.
