ASSESSMENT OF COSTS – REASONS

MICHELLE LAMY, ASSESSMENT OFFICER

[1]               This is the assessment of the respondent’s bill of costs following the judgment dated December 14, 2005, dismissing this application for judicial review.

[2]               On July 17, 2006, I sent a schedule to the parties regarding the service and filing of written representations. As of today, I have not received a response, and am ready to proceed with the assessment on the basis of the proceedings in the record.

[3]               The fees are fixed at $2,250 for the services rendered under items 2 (7 units), 13 (5 units) 14 (3 units x 1 h 15 min.), 25 (1 unit) and 26 (2 units) of Tariff B. The claim under item 27 is denied, as there is nothing in the respondent’s bill of costs to justify it. I also reduced the number of units for the assessment of costs to two, since this is a simple, uncontested matter.

[4]               The disbursements of $255.11, which have been established by affidavit, are allowed as claimed.

[5]               In light of the foregoing, the respondent’s costs are fixed in the amount of $2,505.11, and a certificate is issued for that amount.
