Citation: 2006 FC 1267

ATTORNEY GENERAL OF CANADA

Respondent

ASSESSMENT OF COSTS – REASONS

MICHELLE LAMY, ASSESSMENT OFFICER

[1]               This is an assessment of the bill of costs due to the respondent following a judgment dated June 7, 2005, dismissing the applicant’s application for judicial review with costs. The assessment was made on the basis of the parties’ written submissions.

[2]               In light of the latter, the respondent’s fees are set at $1,636 for the services rendered under items 2 (6 units), 13 (4 units), 14 (2 units/hour x 19 min.) and 26 (3 units). I adjusted the number of units claimed on the basis that the file was not complex for a lawyer specialized in correctional law. It should be noted that the latter withdrew his claims concerning items 25 and 27 of Tariff B.

[3]               Disbursements in the amount of $667.16 are allowed as claimed. In response to the applicant’s comments concerning photocopying costs, the practice of assessment officers is to grant a lump sum of $0.25 per page for copies deemed necessary for a case.

[4]               The respondent’s bill of costs is therefore assessed in the amount of $2,303.16. A certificate is issued for this amount.
