[1]               On May 12, 2004, the Court dismissed the plaintiff's statement of claim. At the request of the defendants, the assessment of their bill of costs proceeded on the basis of the parties' written submissions.

[2]               Given that the defendants made no submission justifying the maximum number of units provided under column III of Tariff B, and taking into account the criteria set out in subsection 400(3) of the Federal Courts Rules, the fees are awarded in the amount $ 840 which is a fair compensation for the services rendered in this matter under the items 5 (4 units), 25 (1 unit) and 26 (2 units). All disbursements established by affidavit are allowed as claimed in the amount of $ 196.52.


[3]               In conclusion, the defendants' costs are taxed in the amount of $ 1,036.52. A certificate is issued for that amount.
