ASSESSMENT OF COSTS – REASONS
FRANÇOIS PILON
Assessment Officer
[1] On November 17, 2000, the respondent, represented by Michelle Lavergne, filed her bill of costs pursuant to the judgment of the Court of Appeal rendered on November 1, 2000, and requested that the assessment proceed on the basis of written representations. Ms. Hélène Beaulieu filed her observations in opposition to the bill of costs on December 15, 2000.
[2] The appellant submits that the respondent's counsel may file only one bill of costs in accordance with the Court's judgment, which reads as follows:
[Translation] The appeal is dismissed with a single set of costs in relation to this appeal and the appeal filed in docket A-157-98.
[3] The two appeals were heard jointly and the Court's judgment is clear and unequivocal; the respondent may submit only one bill of costs for both cases. Having proceeded with the assessment of items in Tariff B in docket A-157-98, I must therefore assess the bill of costs in this case in the amount of $0.
