[1]        Following the judgment by the Court of Appeal on December 9, 2002, dismissing the application for judicial review, the respondent on October 8 last filed his bill of costs accompanied by an affidavit of Simon-Nicolas Crépin. In his service application counsel for the respondent requested leave to proceed in writing.


[2]        In a letter dated October 8, 2003, the Attorney General of Canada asked this Court to file with the office of the Registry of the Federal Court in Montréal the application for service, the judgment and the reasons, the affidavit of Simon-Nicolas Crépin, the bill of costs and the supporting documentation for purposes of service on the applicant, as the latter had no known address, in accordance with subsection 140(3) of the Federal Court Rules.

[3]        In view of the foregoing, I am prepared to proceed with assessment of the respondent's bill of costs. Except for item 26, the fees are awarded as requested. As the bill of costs was not contested, 2 units are awarded under item 26. The fees are accordingly awarded in the amount of $1,430.00.

[4]        The disbursements sought in my opinion are reasonable and justified by Mr. Crépin's affidavit. Accordingly, the disbursements are awarded in the amount of $5,223.46.

[5]        The respondent's bill of costs is assessed and allowed in the amount of $6,653.46. A certificate is issued for that amount.
