[1]      We are all of the view that this motion under section 31 of the Broadcasting Act, S.C. 1991, c. 11, for leave to appeal the Canadian Radio-television and Telecommunications Commission decision dated June 21, 1999, must be granted.

[2]      In our opinion, the grounds on which the appellant intends to base its appeal"jurisdictional error and breached rules of natural justice"are not as futile and frivolous as they would have to be to deny the appellant an opportunity to argue them formally for lack of any reasonable chance of success.

[3]      Leave to appeal is accordingly granted. Costs in the cause.
