[1]                On January 21, 2002, the Court dismissed with costs the appellant's application for judicial review. On July 20, 2005, the respondent filed its bills of costs and asked that it be assessed without the personal appearance of the parties.    As requested, I issued timetables for the written submissions.

[2]                After reviewing the proceedings in the record and the submissions by the parties, the respondent's fees are awarded in the amount of $2,160 for the following items of Tariff B: items 2 (5 units), 13 (3 units), 14 (2 units/hour x 2.5 hours), 25 (1 unit) and 26 (4 units). All claims made under item 5 are disallowed since no costs have been ordered for these interlocutory motions. Given that the unit value was readjusted on April 1, 2005 pursuant to subsection 4(1) of the Tariff, and that the respondent filed its bill of costs after that date, I have made the necessary adjustments in calculating the amount of the fees.

[3]                All the disbursements incurred in this matter, except those related to the interlocutory motions, are allowed as follows: $64.74 for court reporter fees, $31.67 and $52.75 for bailiff services rendered on May 31 and September 25, 2001, and $89.79 for photocopies.    I have reduced by half the expenses for photocopies since a large part of them were made in connection to the interlocutory motions.

[4]                In view of the preceding, the costs of the respondent are assessed in the amount of $2,398.95. A certificate is issued for this amount.
