[1]                The applicant, Janet Reed, was one of the plaintiffs in the proceeding below in which they prevailed on most issues. An appeal was brought by the defendant, Country Park Village Properties (Mainland) Ltd. (Country Park) and the plaintiffs (respondents in the appeal) opted to file an appearance on the advice of their counsel.

[2]                The applicant now wants to disassociate herself from the action taken by counsel for the plaintiffs. She seeks an authorisation to withdraw from the group which filed the appearance and asks for an extension of time to file a cross-appeal in her own name. In the event that her motion to extend time is unsuccessful, she desires to remain a named respondent.

[3]                Her main contention appears to be that she has become adverse in interest to some of the other plaintiffs as a result of the judgement below.

[4]                As Country Park correctly points out in the submissions filed on its behalf, the fact that the applicant may have become adverse in interest to other plaintiffs is not a ground on which the cross-appeal could succeed. In the Court below, the parties agreed that there existed two types of sub-lease lots and the trial Judge simply proceeded to render judgment on that basis. No error can arise from that.

[5]                The applicant's real complaint appears to be directed at plaintiffs' counsel who, according to her, failed to take the proper step and/or to act in her best interest. These considerations have no bearing on the legal validity of the judgement under appeal.


[6]                The applicant in her written materials has also taken issue with a number of purely factual findings made by the trial Judge. These findings are immune for review in the context of an appeal.

[7]                Aside from any other consideration, I can detect no ground on which the cross-appeal could succeed and therefore no basis for allowing the applicant the requested extension. The application for an extension of time to file a cross-appeal will accordingly be dismissed.

[8]                Country Park is seeking costs. However, having regard to the fact that the applicant brought the motion without the assistance of counsel and that her application, although misguided, was brought with the utmost good faith, no costs are awarded against her.
