There is nothing in this case that warrants our intervention.
The principles which the umpire and, before him, the board of referees applied are the principles that this Court laid down in A.G. of Canada v. Jouan (1995), 179 N.R. 127 (F.C.A.) and A.G. of Canada v. Taschuk (1996), 199 N.R. 6 (F.C.A.), in relation to the interpretation of subsection 43(2) of the Unemployment Insurance Regulations, and in A.G. of Canada v. Gates (1995), 125 D.L.R. (4th) 348 (F.C.A.), in relation to the interpretation of subsection 33(1) of the Unemployment Insurance Act.
The matter is then merely a question of assessing the evidence, and the applicant has not established that the lower tribunals could not have reached the conclusion that they reached.
The application for judicial review will be dismissed.
