[1] The appellant sought an order pursuant to Rule 399(2)(a) setting aside the order of this Court made on March 20, 2003 dismissing the appeal. The appellant's motion was dismissed with costs under Tariff B, Column 5 on October 1, 2003.
[2] Ms. Jessica Harris, counsel for the respondent, filed her bill of costs on August 5, 2004 and requested that it be assessed in writing. Dr. Ayangma did not file written submissions in response to my letter sent to parties on August 10, 2004.
[3] Counsel requests the minimum level of units for items 5, 6 and 26 of Column 5. These will therefore be allowed as presented. The disbursements for photocopying and postage are also allowed, being supported by affidavit evidence.
[3] The bill of costs of the respondent is assessed and allowed in the amounts of $1,320.00 for fees and $145.80 for disbursements. A certificate of assessment will issue in the amount of $1,465.80.
