REASONS FOR JUDGMENT OF THE COURT

(Delivered from the Bench at Ottawa, Ontario, on March 14, 2006)

[1]                The applicant applies for judicial review of the decision of the Copyright Board (Board) in which it ruled that the respondents did not have to produce all examinations set by the respondents for the purpose of discovering what copyrighted works of the applicant might have been reproduced in the examinations set by the respondents. There are more than 100 respondents and the amount of material involved would presumably be very great. The Board refused to order production saying:

Some of the information can serve no purpose, given s. 29.4(2) of the Copyright Act. Information should be supplied only with respect to examinations copied outside the establishment.

[2]                In ruling on the issue of what material must be produced by the respondents, the Board adverted to subsection 29.4(2), as a reason why material copied on the premises of the respondents was not relevant in the tariff proceeding. No arguments on subsection 29.4(2) were made by the parties, before the Board, and its reasons are perhaps, for that reason, very brief.

[3]                In our view, the arguments as to whether the exception in subsection 29.4(2) applies so as to deprive the applicant of the right to have a tariff set for the copying of material on the premises of the respondents should be heard by the Board in its main hearing. This is an important issue in the setting of the tariff and the Board no doubt will consider such arguments with an open mind especially because, to date, it has not had the benefit of such arguments. We do not accept that this issue can have been finally determined on the interlocutory motion relating to what documents the respondents were obliged to produce.

[4]                This interlocutory ruling, in any event, would be subject to consideration by this Court by way of judicial review after the Board has issued its final decision on the tariff issue.

[5]                In our view, this appeal does not raise the "special circumstances" as outlined in Szczecka v. Canada, (1994) 116 D.L.R. (4th) 333 (F.C.A.) at 335 and Zundel v. Canada(Human Rights Commission), [2000] 4 F.C. 255 (F.C.A.) at 261.

[6]                The application for judicial review will be dismissed with costs.
