REASONS FOR JUDGMENT OF THE COURT

(Delivered from the Bench at Toronto, Ontario,

     on Monday, May 26, 1997)

     STONE, J.A.:

We are not persuaded that the learned Motions Judge erred in any way that would justify this Court interfering with the judgment of October 17, 1994. While counsel has pointed to some errors in the Refugee Board's understanding of the appellant's testimony, these were not considered by the Motions Judge as so serious as to have vitiated the Board's decision. Accordingly, he determined that the Board was justified in discounting the credibility of the appellant's story. We respectfully agree with that view. The appeal will be dismissed.
