     TAXATION OF COSTS -- REASONS

MICHELLE LAMY, TAXING OFFICER

[1]      The instant case concerns an appeal from a Tax Court of Canada decision dismissed with costs on November 12, 1999. Pursuant to that judgment, the respondent on April 13, 2000 filed her bill of costs and asked that it be taxed without a personal appearance by the parties.

[2]      On May 25, 2000 counsel for the appellant made written submissions in which he indicated he was not opposing the $1,500 fees claimed by the respondent. However, he asked that supporting documentation be provided for the disbursements in the amount of $104.22.

[3]      Following these submissions, the respondent sent the Court an invoice for $70.62 for costs of transcription. On the photocopying costs of $33.60 requested for the making of seven copies of memorandum of fact and law, the respondent explained that this amount resulted from the multiplication of 168 pages (24 times 7) by a cost of 20 cents a unit. Although the respondent provided no invoice for this claim, I feel that the amount requested is reasonable as I can see from looking at the record that in fact a greater number of copies was made by the respondent in the course of this appeal.

[4]      In view of the foregoing and the criteria set out in s. 400(3) of the Federal Court Rules, this bill of costs is taxed in the amount of $1,604.22 and a certificate issued for that amount.
